Terms and Conditions for the Hotels.com John Lewis Voucher Promotion (the "Promotion") By completing an eligible stay as outlined at clause 4 below and therefore participating in the Promotion, you agree to be bound by these terms and conditions (these "Terms and Conditions"). Promotional materials relating to the Promotion, including all information on how to participate in the Promotion, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotion materials and these Terms and Conditions, these Terms and Conditions take precedence. 1. The promoter is Expedia.com Ltd (company number: 03847519) ("Expedia") whose address is at The Angel Building, 407 St John Street, London EC1V 4EX. 2. Participants must be at least 18 years old and legally resident within the United Kingdom. Employees and agents of Expedia or any of its subsidiary or affiliated companies and their immediate families and members of their households, and anyone otherwise connected with operation or fulfilment of the Promotion are not eligible to take part. Expedia reserves the right to require participants to prove that they are eligible. If any participant is found to be ineligible, Expedia reserves the right to require the return of any voucher already awarded to that participant in association with the Promotion. 3. The Promotion commences at 00.01 UK time on 5 May 2012 and ends 23.59 UK time on the closing date of 31 August 2012 (the "Promotion Period"). 4. The Promotion will operate on the www.hotels.com website at the following URL address: http://www.hotels.com/deals/uk-summer-hotel-sale/?pos=HCOM_UK&locale=en_GB (the "Website"). To enter the Promotion and be eligible to receive a John Lewis Gift Card for either £25, £50 or £100 (the "Voucher"), participants must book a stay at a participating hotel during the Promotion Period, which must be completed by 30 September 2012, confirm that they are participating in the Promotion during the booking confirmation process and supply their e-mail and shipping address via the linked provided on the booking confirmation page. The value of the Voucher awarded depends upon the cost of the hotel stay booked excluding taxes and fees. Stays costing between £150.00 and £249.99 will qualify for a £25 voucher, stays costing between £250.00 and £449.99 will qualify for a £50 voucher and stays costing £450.00 or more will qualify for a £100 voucher. You must complete your stay to receive your Voucher. Limit one (1) voucher per booking. Participating hotels are indicated on the landing page at the following URL address: http://www.hotels.com/deals/uk-summer-hotel-sale/?pos=HCOM_UK&locale=en_GB (the "Website") and are subject to change at any time. Applications for a Voucher submitted by any other means will not be accepted: only those submitted via the official method of entry. Any illegible, incomplete or fraudulent entries will be rejected. Promotion is not valid on previous bookings and is subject to availability. You may receive your vouchers in denominations of £25 or £50. 5. Use of the Voucher is subject to the terms and conditions located at the following URL address: http://www.johnlewis.com/Help/Help.aspx?HelpId=46#giftvouchers (the "Reward Terms"). The provision of Voucher does not imply endorsement by Expedia of John Lewis or any other third parties concerned in any way with the Promotion. Any complaints or queries relating to the use of the Voucher should be directed to John Lewis. 6. Only Vouchers can be received as part of the Promotion and all Vouchers are as stated and are non-exchangeable and non-transferable. There is no cash or other alternative to the Voucher in whole or in part. By participating in the Promotion, participants agree that the Voucher is awarded on an "as is" basis, and that neither Expedia nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the Voucher. 7. Participants who book an eligible hotel stay must confirm their participation in the Promotion as indicated on the Website during the booking confirmation process. After booking, participants will be directed to a form via a link on the booking confirmation page where they must fill out their shipping and email details in order to receive the voucher. Shipping address must be located within the United Kingdom. Within four (4) weeks of completing their stay, participants will be sent their Voucher via second class post to the shipping address they have provided. 8. In the event that, for reasons beyond Expedia's reasonable control and not related to the operation of the Promotion, Expedia is unable to award the Voucher as described in these Terms and Conditions, Expedia reserves the right to award a promotional item of a similar nature and an equivalent value. 9. Expedia and Hotels.com will collect and process participants' personal information in order to conduct the Promotion and it will be shared with Expedia's agents to the extent necessary for the Voucher to be delivered. If participants do not provide any of the mandatory information requested when entering the Promotion, they shall not be eligible to receive a Voucher. Participants' names and other personal details from their application to the Promotion will be collected and stored by Hotels.com and held in accordance with the applicable privacy policy in place from time to time (see http://www.hotels.com/customer_care/privacy.html). 10. Expedia reserves the right to modify, cancel, terminate or suspend the Promotion in whole or in part, at its sole discretion, if it believes the Promotion is not capable of being conducted as specified within these Terms and Conditions or in the event of a virus, a computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of Expedia that could corrupt or affect the administration, security, impartiality or normal course of the Promotion. Neither Expedia, Hotels.com nor any of their subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures or delays caused by events beyond their control such as (but not limited to) the acts or defaults of any supplier selected by Expedia to provide the Voucher or otherwise that may cause the Promotion to be disrupted or corrupted, or that may lead to loss or damage of the Vouchers in transit to participants. 11. Save where they have been negligent, Expedia and Hotels.com will not be responsible for any damage, loss or injury resulting from participants' entry into the Promotion or their acceptance and/or use of the Voucher, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate in the Promotion. Expedia and Hotels.com will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable applications for Vouchers. Nothing in these Terms and Conditions shall in any way limit Expedia's or Hotels.com's liability for death or personal injury caused by their negligence or for any other matter where liability may not as a matter of law be limited. 12. Any participant who enters or attempts to apply for the Promotion in a manner, which in Expedia's reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other participants (including without limitation tampering with the operation of the Promotion, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or Expedia, Hotels.com and/or any of their agents or representatives) may be rejected from the Promotion at Expedia's sole discretion. Furthermore, where such actions have significantly impaired the Promotion, Expedia may, at its sole discretion, add further stages to the Promotion as it deems reasonably necessary in order to resolve any problems arising as a result of such actions. 13 All Expedia's decisions in relation to the Promotion are final and Expedia will not enter into any correspondence with participants. 14. These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Promotion or these Terms and Conditions.
